UNITED ASSOCIATION OF UNION PLUMBERS, PIPEFITTERS, STEAMFITTERS, SERVICE TECHNICIANS, AND SPRINKLERFITTERS LOCAL UNION 693 BARRE, VERMONT BY-LAWS APRIL 7, 2005

PREAMBLE. We believe that organizing ourselves into a body for the purpose set forth in the following By-Laws is the method by which we are to derive the most benefits under the fairest conditions to ourselves as Journeymen Plumbers and Pipefitters and we hereby affix our signature in approval thereof, certifying that we will abide by the rules and decisions of the Local Union.
Section 1. NAME. The name of this Association shall be known as Local Union No. 693 of the United Association of Union Plumbers, Pipefitters, Steamfitters, Service Technicians, and Sprinklerfitters of the United States and Canada.
Section 2. CONSTITUTION. These By-Laws are in no way intended to abrogate any part of the United Association Constitution of Laws or Ritual of the United Association in relations to Locals, but to further protect the local condition of Local Unions and all sections and rules in these By-Laws shall be in force and binding on its officers and members.
Section 3 (A). MEMBERSHIP - BUILDING TRADES. Every applicant for membership as an apprentice or journeyman in the Building and Construction Trades must meet all the requirements set forth in the United Association Constitution.
Section 3 (B). INITIATION FEE. The initiation fee for new members henceforth $200.00 (two hundred dollars) upon acceptance of application by the Examining Board.
Section 4 (A). MEMBERSHIP - METAL TRADES. Every applicant for membership as an apprentice for journeyman in the Metal Trades must meet all the requirements set forth in the United Association Constitution.
Section 4 (B). INITIATION FEE. The initiation fee for Metal Trades apprentices and journeymen shall be $200.00 (two hundred dollars).
Section 5. APPLICATIONS. Anyone who shall certify to any false statement or fact, falsely answer on any of the official forms of application for membership, or file false and fraudulent affidavits, or otherwise by any false pretense, misrepresentation, or fraud, attempt to secure or does secure, acceptance as a member of this Local Union, shall immediately forfeit all further rights to consideration as an applicant and shall immediately forfeit membership by immediate cancellation if membership has already been acquired or established in the manner specified herein, upon evidence of such false pretenses, misrepresentation, or fraud being presented to the local union officers.
Section 6. LOANS. This Local Union shall under no circumstances lend any part of its funds to any of its members.
Section 7. OFFICERS. The elective Officers of this Local Union shall be: President, Vice-President, Business Manager/Agent and Financial Secretary, Treasurer, Recording Secretary, Executive Board of five (5) members, Inside Guard, Finance Committee of three (3) members, and the Examining Board of five (5) members. Term of office shall be three (3) years. No member shall be elected to more than one (1) office at a time.
Section 8. BONDING. All officers (and appointed committee members) will be bonded in an amount consistent with the Labor-Management Reporting and Disclosure Act of 1959.
Section 9. DUTIES OF THE PRESIDENT. The President shall preside over all meetings and conduct the same in conformity with general supervisory control over all matters pertaining to the welfare of the Local Union. The President shall be ex-officio over all committees. He/She shall have the power to appoint all committees not otherwise provided for and fill all vacancies on such committees; to call special meetings when requested to do so, stating the object of such call, and members shall be notified of such meetings by mail. He/She shall attend all meetings, see that all officers are in their proper places, and also see that none but members in good standing take part in any part of the meetings of this Association. He/She shall not vote on any questions before the house, but shall have the deciding vote in case of a tie, except at an election to any office, when he/she shall have a right to vote for the candidates. For the faithful performance of his/her duties, he/she shall receive free dues, and be paid $25.00 (twenty-five dollars) a month. He/she shall be authorized to co-sign Local Union checks.
Section 10. DUTIES OF THE VICE-PRESIDENT. The Vice-President shall be chairman of the Executive Board and have supervision over all members entering the assembly room and upon a member presenting his/her dues book in good standing he/she will give him the password. He/She shall also have supervision over all members departing from the room, assist the President to keep order during the meetings, and in absence of the President, will assume the chair.
Section 11. DUTIES OF THE BUSINESS MANAGER/AGENT-FINANCIAL SECRETARY. The Business Agent and/or Business Manager meets in daily contact with the public and with the employer, becoming trustee of the welfare of the members of the Local Union. It is his/her solemn duty and obligation to vigilantly protect the trade jurisdiction of the United Association in the plumbing and pipefitting industry of his/her locality; also to compel employers to observe and respect collective bargaining agreements, adjusting all grievances between members of his/her Local Union and their employers with justice and fairness, as well as fostering and promoting employment for the members of this Local Union.
The Financial Secretary shall keep a correct account of the financial standing of all members of the Local Union, receipt and account for all money received or disbursed by order of the Local Union. He/She shall, not later than forty eight (48) hours after the last day of the calendar month, forward to the General Office the per capita for Building and Construction and Metal Trades monthly dues and all other dues, assessments, reinstatement fees, and initiation fees as set forth in the United Association Constitution.
These remittances shall be forwarded on the original cash sheets furnished by the General Office, with the seal of the Local Union attached, the same to be countersigned by the President and Financial Secretary, the duplicate case sheet to be retained by the Local Union, subject to the inspection of the Finance Committee. The Secretary shall record on the cash sheets the names of all members who have been initiated, reinitiated, and reinstated on the depositing of withdrawal cards and transfer cards which have been accepted.
After the end of each calendar year the Financial Secretary of the Local Union will receive the January cash sheet from the General Secretary-Treasurer of the United Association and such cash sheet will be considered a verification sheet of the December payments of the previous year. This sheet will contain the name, card number, and status of each member in the Local Union. The Financial Secretary of the Local Union will check this record with his/her records and will notify the General Secretary-Treasurer of any discrepancy.
If the General Secretary-Treasurer of the United Association receives no changes or corrections from the Financial Secretary of the Local Union within sixty (60) days after receiving the January verification sheet, the records in the United Association offices will stand correct and official.
It shall be the duty and responsibility of the Financial Secretary to obtain a surety bond for the Local Union so that every Officer, Agent, Representative, or Employee of the Local Union who handles funds or other property of the Local Union shall be bonded as required by law.
The Business Manager/Agent-Financial Secretary shall receive a weekly salary equal to the highest General Foreman's rate referred to in the current Collective Bargaining Agreement. Such salary shall be based on a forty (40) hour work week and shall include all fringe benefits contained in the Collective Bargaining Agreement. He/She shall also be reimbursed for all mileage and expenses incurred while performing Union business and shall receive free dues stamps. He/She shall be authorized to co-sign Local Union checks.
The Business Manager/Agent-Financial Secretary shall perform such duties as are stated in the Local Union Collective Bargaining Agreement, the United Association Constitution, and these By-Laws. He/She shall also perform such duties as may be assigned him/her by the Local Union.
Section 12. DUTIES OF THE TREASURER. The Treasurer shall maintain a record of all cash expenditures, cash receipts, and the Local Union checkbook. He/She shall maintain a checking account that requires two (2) signatures for all disbursements. All disbursements made on behalf of the Local Union shall be by check, and supported by receipts, vouchers or other reasonable proof of claim. He/She shall be authorized to pay all routine bills that are incurred on a regular basis. He/She shall be placed under bond with some reputable bonding company, the bond to be paid for by the Local Union. For the faithful performance of his/her duties, he/she shall receive free dues stamps and shall be paid $25.00 (twenty five dollars) a month. He/She shall be authorized to co-sign Local Union checks.
Section 13. DUTIES OF THE RECORDING SECRETARY. The Recording Secretary will keep a record and intelligent account of all resolutions, motions, and the general business transacted at Local Union meetings; perform any other duties, special or otherwise, that may develop upon him/her by action of the Local Union. He/She shall immediately, after election of officers, forward to the General Secretary-Treasurer, the names and addresses of the officers, upon blanks furnished by the United Association. The Recording Secretary shall also handle all official correspondence to the United Association Journal. For the faithful performance of his/her duties, he/she shall receive free dues stamps and shall be paid $25.00 (twenty five dollars) a month.
Section 14. EXECUTIVE BOARD. The Local Union Executive Board shall consist of five (5) members who shall include the Vice-President of the Local Union who by virtue of his/her office shall be a member thereof, and Chairman of the Executive Board. The Local Union Executive Board shall be empowered to comply with the direction of the General Executive Board of the United Association. They shall try all cases where there are written charges preferred by or against any member, to determine those cases with impartiality. The Local Union Executive Board shall, between meetings of the Local Union, transact such business as may be referred to it by the Local Union or the duly elected Local Union Officers. Members of the Local Union Executive Board shall receive one dues stamp for every month in which they attend an Executive Board meeting.
Section 15. INSIDE GUARD. The Inside Guard shall have charge of the door, and be under direct supervision of the Vice-President.
Section 16. FINANCE COMMITTEE. The Finance Committee shall meet with the Financial Secretary at least twice a year, once in September and once in February, to examine the cash receipts and disbursements book, bank statements, and any other documents pertaining to the financial condition of the Local Union. The Finance Committee shall report their findings to the membership at the Monthly Meetings in October and March. All expenditures shall be approved by the Finance Committee or a member thereof present at a regular or special meeting.
Section 17. EXAMINING BOARD. The Examining Board shall examine and determine the qualifications of applicants for Building and Construction Trades, or Metal Trades Journeymen applicants and before applicant is admitted and initiated as a Journeyman member of Local Union, and thereby eligible to work in the jurisdiction of the Building and Construction Trades or Metal Trades Department of Local 693, he/she must pass an examination. Examining Board Members shall receive one free dues stamp for each examining session administered.
Section 18. NEGOTIATING COMMITTEE. A Negotiating Committee shall be appointed by the President not less than three (3) months prior to the expiration of the existing contract. The Committee shall consist of the Business Manager/Agent and four (4) appointed members.
The duties of this Committee shall be to negotiate the best possible contract with the Employers. Their acts as such shall be binding on the Local unless set aside by a majority of the members present at a special or regular meeting. Compensation shall be paid at the prevailing wage rate for working time lost in the performance of said duties.
Section 19. GRIEVANCE COMMITTEE. The Grievance Committee shall consist of three (3) members appointed by the President. They shall meet and settle disagreements as set forth in the Collective Bargaining Agreement. Compensation to be paid at the prevailing wage rate for working time lost in the performance of said duties.
Section 20. ELECTION COMMITTEE. The President shall appoint an Election Judge and two (2) tellers, who shall serve as an Election Board to conduct the Election. No candidate for office shall be eligible to serve on the Election Board.
Section 21. ELIGIBILITY FOR OFFICE IN LOCAL. Eligibility for office in the Local Union shall be set forth in the United Association Constitution (Sections 121-122).
Section 22. ELECTION OF LOCAL OFFICERS. All Officers of Local Unions shall be elected for a term of not less than three (3) years. Nominations for Officers of Local Unions shall be held during the month of May and the elections shall be held during the month of June and shall comply with all the regulations set forth in the United Association Constitution. A member placing the name of another member in nomination for office (that is not present), must give to the Recording Secretary evidence in writing, signed by the nominee, the nominee agrees to be a candidate for that particular Local Union office.
Section 23. DELEGATES TO THE NATIONAL CONVENTION. Delegates to the National Convention shall be elected by secret ballot according to the appropriate sections of the United Association Constitution. Delegates to all other conferences shall be elected at the regular monthly meeting prior to the conference. The Business Manager/Agent shall be a delegate to all conventions and conferences by virtue of his/her office. Delegates attending conferences outside of Vermont shall be paid a regular days pay for each day attending the conference, or actual expenses, whichever is more.
Section 24. STEWARDS. Stewards shall be appointed (where needed) by the Business Manager/Agent or President. They shall work under his/her direction and be subject to his/her authority. He/She can remove any Steward, as such, at any time. Duties of a Steward shall be as follows: To have a copy of these By-Laws and the Working Agreement and rules with them at all times, To report any encroachment upon the jurisdiction of this Local Union, To report to the Business Manager/Agent any violation of our laws, agreements, or rules. To perform such other duties as may be assigned them by the Business Manager/Agent. The Steward shall in no case cause a stoppage of work. In case of any trouble on a job or at a shop, Stewards shall immediately notify the Business Manager/Agent.
Section 25. MEETINGS. The regular meetings of this Local Union shall be held on the first Thursday of each month. The President or Business Manager may if he/she sees sufficient cause, or in case of emergency, call a special meeting at any time.
Section 26. QUORUM. Ten (10) members in good standing shall constitute a quorum.
Section 27-28. DUES & ASSESSMENTS. Except as otherwise provided in the United Association Constitution and by By-Laws it shall require a majority vote by secret ballot of the members present and voting to levy local dues and assessments. However, no motion or resolution to levy any local assessment shall be voted on at the meeting when it is introduced, but must be laid over for at least two (2) weeks. During such period the membership of the Local Union shall be given reasonable notification by mail regarding the proposed motion or resolution, and the date when final disposition of the matter will be made.
Regular dues for retired or disabled members shall be United Association per capita per month. Local 693 shall be responsible for the United Association per capita per month for all retired members with thirty-five (35) years or more of service. All members within the jurisdiction of Local 693 shall pay the same working dues and working assessments, which will be paid through payroll deduction. Working dues and working assessments for apprentices shall be 50% of journeyman rate, which will be paid through payroll deduction.
Section 29. STRIKE. No member shall be considered on strike unless sanctioned by this Local Union through its regular authorized agents.
Section 30. TOOLS. No member working within the jurisdiction of this Local Union shall be allowed to furnish tools other than those the present Collective Bargaining Agreement calls for.
Section 31. GOOD OF THE UNION. Any member who willfully conveys any information about the business or transactions of the Local Union to any outsider which is calculated to harm the interest of this Local Union, shall, upon conviction after a fair trial by the Executive Board, face disciplinary action. It is imperative that the Local Union exercises caution when entertaining charges under this section.
Section 32. ROLL CALL. At each meeting, after reading of the minutes, the President shall announce Roll Call of Officers, and he/she shall call the names of the officers and the positions they hold, and the Recording Secretary shall keep a complete list of the attendance or non-attendance of the officers.
Section 33. BY-LAW CHANGES. The By-Laws or any part thereof may be altered or amended in the following manner: A written resolution embodying the proposed alteration or amendment shall be submitted on a Local 693 by-Law Change Form located at the office of Local 693 and read at one (1) regular meeting previous to the meeting when the proposed alteration or amendment is to be acted upon, and notice of this meeting shall be given previously of the intended action; said resolution or proposition shall be adopted only by a two-thirds vote of eligible members voting. The Recording Secretary shall have printed the proposed amendment for distribution at the special meeting of said action.
Section 34. OFFICER VACANCY. A vacancy in the office of either President or Vice President with less than one year remaining in the term of office shall be filled by appointment by the Business Manager. A vacancy in the office of Business Manager with less than one year remaining in the term of office shall be filled by appointment by the President. In the event of any other vacancy in the office of either President or Vice President, the Business Manager shall appoint an interim officer to serve until an election can be held to fill the balance of the unexpired term. In the event of any other vacancy in the office of the Business Manager, the President shall appoint an interim Business Manager to serve until an election can be held to fill the balance of the unexpired term. All other vacancies shall be filled through appointment by the President.
Section 35. DUTIES OF THE ORGANIZER. The Business Manager may appoint an Organizer who shall serve under the direction and control of the Business Manager. The Organizer shall receive a weekly salary equal to current assistant foreman’s rate, based on a forty (40) hour week, and shall include all fringe benefits and commitments contained in the Collective Bargaining Agreement. He/she may be reimbursed for all mileage and expenses incurred while performing the duties assigned by the Business Manager. A yearly budget shall be submitted to the Target Committee. The Target Committee will submit to the membership for approval.
The Business Manager/Agent will submit the name(s) of Local 693 members at least two (2) weeks prior to the monthly meeting at which they are to be voted on. A simple majority vote will confirm the nomination. The position of Organizer will stand for reconfirmation vote every twelve (12) months from time of confirmation.
Section 36. OFFICERS MISSING MEETINGS. After an elected officer misses three (3) consecutive meetings without reasonable excuse, his/her office will be declared vacant and the position will be filled by appointment by the Business Manager for the period remaining in the term. The procedures set forth in Section 34 will not apply to appointments made pursuant to this section.
